Terms of Service

These Terms of Service are an agreement between you and X & Company LLC (“Stockfiti,” “we,” “us”), which operates stockfiti.com. By using Stockfiti you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use the service.

You must be at least 13 years old to use Stockfiti. If you use Stockfiti for an organization, you confirm you’re authorized to accept these Terms for it.

Anyone can browse the wall. Posting requires an account. You sign in with a one-time link we email you, or with your Google account; there’s no Stockfiti password, so the security of your account depends on the security of your email and Google accounts. Keep them secure and tell us at legal@stockfiti.com if you think someone else has gained access.

One person, one account. Creating extra accounts to get around daily limits or a suspension isn’t allowed.

Stockfiti is free. Every feature, including all lettering styles, any paint color, calls, alerts and emails, is included at no charge, and there’s nothing to buy. We may show advertising on Stockfiti in the future, and we may add, change or remove features.

To stop floods and automated abuse, each account can post up to 100 tags and 100 comments a day, and at most 5 tags on any one symbol in 24 hours. A “day” runs from midnight to midnight UTC, and every tag you post counts, including tags held for review or removed. Reactions aren’t limited. We also limit how fast any one visitor can post or make requests, and we may change these limits.

You own what you write. By posting a tag or comment, you give us a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce and distribute it, including as images, on share previews on other sites, and in promoting Stockfiti, for as long as it’s on the service. This license ends when it’s removed, except for copies in backups kept for a limited time and anything others have already shared.

Tags are public. Anyone can see, link to, download and share them, and they can’t be edited after posting. Don’t post anything you wouldn’t want the world to see. Your email address is never shown with your tags.

Comments are public too, shown under your handle. A handle is permanent once you set it: you can’t change it afterwards. Handles must not impersonate anyone or be offensive; we may remove one that is, and you’d then pick a new one. The same rules apply to comments as to tags, and Free accounts’ comments are limited per day.

You’re responsible for your tags and comments and confirm you have the right to post them.

Don’t use Stockfiti to post or do anything that:

• attacks or demeans people based on race, ethnicity, religion, gender, sexual orientation, disability or similar traits;
• harasses, threatens or encourages violence or self-harm against anyone;
• shares anyone’s personal or confidential information;
• is sexually explicit, or involves minors in any sexual way;
• is intended to manipulate the market, such as coordinating a “pump and dump,” spreading information you know is false to move a price, or posting material non-public information;
• impersonates a person, company or Stockfiti;
• is spam, advertising, links, or scams;
• infringes someone else’s intellectual property or other rights, or breaks the law;
• interferes with the service: automated posting or scraping, getting around limits or moderation, probing for vulnerabilities without permission, or overloading our systems.

We may review, hold, hide or remove any tag or comment, change or remove a handle, and suspend or close any account, at our discretion, including for breaking these rules. Tags and comments may be checked automatically before or after they appear. Signed-in members can report a tag or comment with its Report button, once each. We aren’t obliged to monitor content and aren’t responsible for what users post.

Stockfiti is a place to paint opinions, not a source of investment advice. Tags are written by users and reflect their views only. Nothing on Stockfiti is a recommendation to buy, sell or hold any security or cryptocurrency, and we don’t verify what users write. Bull and bear calls, their scores, hit rates and the leaderboard are records of users’ past opinions measured against delayed prices. They aren’t recommendations or endorsements of anyone, and past results don’t predict future ones. Ticker names and symbol lists come from third-party sources and may be incomplete or out of date. Prices and charts may be delayed, come from third-party data providers, are for information only and may be inaccurate or incomplete; don’t trade on them. Make your own decisions and consult a licensed professional.

The Stockfiti name, logo, site design and software belong to X & Company LLC or its licensors. Fonts are used under their open licenses. These Terms don’t give you any right to use our branding.

If you believe a tag infringes your copyright, send a notice to legal@stockfiti.com or 506 Traveler Ln, Madison, WI 53718 with: your contact details; the work you believe is infringed; the link to the tag; a statement that you believe in good faith the use isn’t authorized; a statement, under penalty of perjury, that your notice is accurate and that you’re the owner or authorized to act for them; and your physical or electronic signature. We’ll remove infringing tags and close the accounts of repeat infringers.

Stockfiti relies on other providers, such as Google for sign-in. Their own terms apply to your use of them, and we aren’t responsible for them.

Stockfiti is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We don’t promise the service will be uninterrupted, error-free or secure, or that any tag will remain available.

To the fullest extent the law allows, X & Company LLC and its owners, employees and suppliers won’t be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, trading or investment losses, lost data or goodwill, arising from your use of Stockfiti. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim or US $50. Some places don’t allow these limits, so they may not all apply to you.

If someone brings a claim against us because of your tags or your breach of these Terms, you agree to cover the reasonable costs, including legal fees, to the extent the law allows.

You can stop using Stockfiti any time, and ask us to delete your account by emailing legal@stockfiti.com. We may suspend or end your access if you break these Terms or if we stop offering the service. Sections that by their nature should survive (such as the content license for tags already shared, disclaimers, limits of liability and governing law) survive termination.

These Terms are governed by the laws of the State of Wisconsin, USA, without regard to conflict-of-law rules. Any dispute will be heard in the state or federal courts located in Wisconsin, and you and we consent to their jurisdiction, except that either of us may bring a claim in small-claims court where eligible. If you’re a consumer in a country that gives you the right to bring claims in your local courts, nothing here removes that right.

We may update these Terms. We’ll change the date at the top and, for material changes, tell signed-in users by email or on the site before they take effect. Continuing to use Stockfiti after that means you accept the updated Terms. If a provision is found unenforceable, the rest remain in effect. These Terms and the Privacy Policy are the entire agreement between us about Stockfiti.
